These Terms of Service (“Terms”) govern your use of the LJ Scaffold website (ljscaffold.com) and any services provided by LJ Scaffold (“we”, “us”, “our”).
1. Acceptance
By accessing this website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. Scope of Services
LJ Scaffold provides AI automation, custom application development, consulting, and managed services for businesses. All services are subject to a separate Statement of Work (SOW) or service agreement that defines scope, deliverables, timelines, and pricing.
3. Discovery Calls
Discovery calls are free, 30-minute consultations with no obligation. They are intended to assess your needs and determine whether our services are a good fit. No work is commenced until a formal agreement is signed.
4. Service Delivery
We offer project-based (one-off) and ongoing (Growth Partner) engagements. Timelines provided on this website and in proposals are estimates and may vary depending on project complexity, client responsiveness, and third-party dependencies.
5. Pricing & Payment
- All prices on this website are in Australian Dollars (AUD) and exclude GST unless stated otherwise.
- Prices shown are starting prices. Final pricing is confirmed in the SOW after the discovery call.
- Payment terms are specified in individual service agreements.
6. AI Accuracy Disclaimer
Important
AI-powered tools and outputs are designed to assist, not replace, human judgement. LJ Scaffold does not guarantee the accuracy, completeness, or reliability of AI-generated content. Clients are responsible for reviewing and verifying all AI-generated outputs before acting on them, particularly in safety-critical or compliance-sensitive contexts.
7. Construction & Safety Disclaimer
Safety-critical applications
AI tools provided by LJ Scaffold are not a substitute for qualified professional advice in safety-critical applications. Always consult licensed professionals for matters involving workplace health and safety, structural engineering, building compliance, or any other regulated activity. Our AI automation tools are designed to assist with administrative and operational tasks, not to make safety or compliance decisions.
8. Intellectual Property
Upon full payment, clients receive ownership of:
- All custom source code, configurations, and documentation created specifically for their project
- All data stored in client-owned accounts (databases, hosting, repositories)
Clients do not receive ownership of:
- Underlying AI model weights or third-party API access (these remain with their respective providers)
- Open-source software components, which retain their original licences
- General techniques, methodologies, and non-client-specific tools developed by LJ Scaffold
9. Data Handling
Your data is handled in accordance with our Privacy Policy. For client projects, data ownership and handling terms are specified in the relevant service agreement.
10. Warranties & Support
All projects include a warranty period as specified in the service agreement (14–90 days depending on project scope). During this period, we will fix bugs or issues related to the delivered work at no additional cost.
11. Refund Policy
If services are not delivered as scoped in the SOW, we will work with you in good faith to resolve the issue. This may include additional revisions, scope adjustments, or a partial refund as appropriate. Our goal is to ensure you receive the value agreed upon.
12. Limitation of Liability
To the maximum extent permitted by law, LJ Scaffold’s total liability for any claim arising from or related to our services is limited to the amount paid by you for the specific service giving rise to the claim.
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
13. Termination
For ongoing Growth Partner engagements, either party may terminate with 30 days’ written notice. Upon termination, you retain ownership of all work completed and paid for. Project-based (one-off) engagements are governed by the terms in their respective SOW.
14. Dispute Resolution
In the event of a dispute arising from these Terms or our services:
- Good faith negotiation: Both parties will first attempt to resolve the dispute through direct discussion.
- Mediation: If negotiation does not resolve the dispute within 30 days, either party may refer the matter to mediation administered by an agreed-upon mediator.
- Court proceedings: If mediation does not resolve the dispute, either party may commence court proceedings.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. Any disputes will be subject to the jurisdiction of the courts of Western Australia.
16. General Disclaimer
Results, savings, and performance figures shown on this website are estimates based on industry benchmarks and typical use cases. Your actual results will depend on your specific circumstances, data quality, and business context. Case studies and examples on this website represent estimated potential outcomes, not guaranteed results. Comparisons with other provider types reflect general industry patterns and may not reflect every individual provider.
17. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
